Depends on the EULA with his version of OEM. w/o reading a copy I am not 100% sure... my Upgrade Ultimate EULA is different from my Retail EULA and the 2 Family Edition Versions of Home Premium are still different....

Every computer (NEW) that I have worked on that did not have a DISK with it, contained the HD version of a DISK in a hidden partition, I have also copied that info to a CD or DVD as needed and had a RESTORE (disk).

I do not have a OEM version of Vista to check...the EULA.
