Actually, the assembler and end user could be the same person. That's why I feel that MS is putting the responsibility on the individual assembler. (I think we need a lawyer )

Right, but what Jay posted implies that the end-user is not supposed to be the assembler under the MS rules. So, it looks like Newegg is not making sure that this MS intention is being carried out.

Code:
OEM system builder software packs are intended for PC and server manufacturers or
assemblers ONLY. They are not intended for distribution to end users. Unless the end 
user is actually assembling his/her own PC, in which case, that end user is considered 
a system builder as well.
MS does define an end user that is building their own box a system builder.

The COA is the sticker that you are supposed to attach to the computer. It contains the key. For retail versions, it may be attached to the top of the software package and the key is on the inside of the package.

You are right. Thanks. I read too quickly. Sorry for misstating--especially to felix. Now, i see what he meant. So, I wonder if Newegg is at least asking if the user is a PC assembler in any sense. This discussion has really helped me guys. Thanks to all who participated. I wonder if one can change the graphics card in a major way and install a better hard drive in, for example, a Dell and be considered to be a PC assembler.

If you're looking to get a head start on Vista, Newegg has the 32-bit version of Vista Ultimate up for $199.

More legit than bittorrent, but a little less legit than retail, this OEM version is supposedly only for OEMs. That doesn't stop Newegg, or you, from getting one for yourself. Quite a good deal, seeing as the retail version of Vista Ultimate is $399, and the upgrade is $259.

Surely MS knows what't going on with selling the OEM's apparently to "anyone." Maybe MS is not objecting yet to get more copies in users hands ASAP.
